Liability Waiver

I have voluntarily decided to enroll in, or on behalf of my dependent, one or more courses of dance instruction taught by employees of Virginia Dance Conservatory LLC. I recognize the value of that instruction and in exchange I agree to the following:

Grant of Right: I hereby irrevocably grant Virginia Dance Conservatory (“VDC”) permission to use, adapt, modify, exploit, reproduce, distribute, publicly perform and display whether or not for profit, my or my dependent’s image or visual likeness, name and voice (together and separately “Personal Information”) now known or later developed (“Materials”) such as, but not limited to, photography, video recordings, publications, brochures, and internet websites. The Materials may be used to promote and publicize VDC’s programs and for any other lawful purpose. VDC is and shall be the exclusive owner of all right, title and interest, including copyright, in the Materials containing my Personal Information.

Waiver of Editorial Rights and Royalties: I waive any right I or my dependent may now have or later acquire to approve, edit, alter, copy, exhibit, publish or distribute the Material for the purpose of promoting or publicizing VDC and VDC programs or for any lawful purpose. I also waive my or my dependent’s right to royalties or other compensation arising from the use of my or my dependent’s Personal Information in the Materials. This waiver includes any party who might be able to claim rights or royalties through me or my dependent.

Release: I hereby release VDC from any and all claims arising out of or in connection with the use of my or my dependent’s Personal Information in the Materials. This release includes my and my dependent’s heirs, representatives, executors, administrators or any other person acting on my or my dependent’s behalf or on behalf of my or my dependent’s estate.

Waiver for Physical Injury: I understand that my or my dependent’s participation in dance instruction and in any rehearsal or performance will expose me or my dependent to physical injury and harm. I understand that I should be aware of my and my dependent’s physical limitations and agree not to exceed them. I am willing to accept the entire risk of any direct or indirect loss or damage including financial loss, I or my dependent suffer because of any physical injury or harm incurred in connection with activities with VDC. On behalf of myself, my dependent and any party who might be able to make a claim by or through either or both of us, I waive all claims we may have for physical injury suffered from my or my dependent’s participation in dance instruction and in any rehearsal or performance in which I or my dependent participate.

COVID - 19: I acknowledge that an inherent risk of exposure to COVID -19 exists in any public place where people are present. By attending dance classes, I or any dependents or guests voluntarily assume all risks related to exposure to COVID -19 and agree not to hold Virginia Dance Conservatory, LLC or any of its affiliates, employees, contractors or volunteers liable for any illness.

Release: I hereby release and indemnify VDC and VDC’s affiliates, subsidiaries, owners, agents, volunteers, assistants, employees, guest artists, faculty members and students (jointly and severally referred to as “Indemnified Parties”) from and against any liability for physical injury, illness or harm described in this Waiver, including legal fees and court costs.

Waiver for Loss of Personal Items of Property: I also acknowledge that I and my dependents will bring personal effects and property onto the VDC premises and we are solely responsible for the safekeeping and security of those effects and property. I indemnify and save VDC and indemnified Parties from and against any liability, claim or loss arising out of or in connection with loss or damage to my or our personal effects and property.

Acknowledgement: I have provided VDC with proof of my age in the form of a birth certificate or driver’s license unless this requirement is waived by VDC (in which case a parent or guardian must sign). If 18 years of age or older, I have read this release and am fully familiar with its contents. If I am under 18 years of age, then my parents or guardian, by signing below, acknowledge that they have read and understand the contents of this release. The undersigning gives their full and unqualified consent to the terms of this Release and License.

Miscellaneous: This Use Image, Waiver of Liability and Release (“Agreement”) is governed by the laws of the Commonwealth of Virginia. This is our sole agreement regarding the use and ownership of my Personal Information and my waiver of claims against VDC for physical injury, illness or property loss or damage. This Agreement may not be changed in any way unless in a written document signed by VDC and the undersigned. This Agreement shall inure to the benefit of VDC and myself and to our respective heirs, successor and permitted assigns.

Refund Policy: Tuition refunds will not be granted.
